Article 1 - Definitions

In these conditions apply:

  1. Reflection Period: Within this period the consumer can use his right of withdrawal;
  2. Consumer: the natural person not acting in the execution of profession or business, association or other legal entity and a distance contract with the entrepreneur;
  3. Day: calendar day;
  4. Transaction: a sale agreement concerning a series of products and / or services, the supply and / or purchase which is spread over time;
  5. Durable data carrier: any medium that enables the consumer or business to store information that is directed to them personally in a way that makes future consultation and unaltered reproduction of the stored information possible.
  6. Right of withdrawal: the ability for consumers to reject their purchase, within the reflection period of the contract;
  7. Return form: the withdrawal form which makes it easy for the customer to use his right of withdrawal. This form has been made by the entrepreneur;
  8. Entrepreneur: the natural or legal person that sells online products and / or services to consumers;
  9. Agreement on online purchase: an agreement in which, in the context of an online shopping organized by the entrepreneurs system of products and / or services, up to and including the conclusion of the agreement exclusive use is made of one or more means of online communication;
  10. Technology for online communication: A means that can be used to conclude an agreement, without the consumer and entrepreneur being in the same space.

CEK Zwijndrecht is the official distributor for GK Elite Sportswear, LP For Belgium, the Netherlands, Austria, Portugal, Spain, Turkey and all other countries in Europe which for some reason and at any time have no distributor.

Article 3 - Applicability

These conditions apply to all deliveries and services of CEK Zwijndrecht in the performance of tasks that do not come from business customers, companies or clubs, associations or other group orders.

When you make an online purchase at CEK, these terms and conditions will be offered to you before you complete the purchase. If you check the checkbox, we assume that you have read our terms and conditions carefully, and that you agree with them.

Article 4 - The offer

  1. If an offer is subject to special conditions, this will be explicitly stated in the offer.
  2. The offer is non-committal. CEK is entitled to change the offer and adapt.
  3. The offer includes a complete and accurate description of the offered products and / or services. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer. If CEK uses images, these are a true reflection of the products and / or services. Obvious mistakes or errors in the offer do not bind CEK.
  4. All images, data specifications in the offer are indicative and cannot give rise to damages or termination of the contract.
  5. Images of products are a true representation of the products offered. CEK cannot guarantee that the displayed colors correspond exactly to the real color of the products.
  6. Each offer contains such information that it’s clear to the consumer what rights and obligations are attached to accepting the offer.

Article 5 - The contract

  1. The agreement is, subject to the provisions of paragraph 4, concluded at the time of the consumer accepts the offer and agrees with the corresponding conditions.
  2. If the consumer has accepted the offer electronically, CEK will immediately acknowledge electronic receipt of acceptance of the offer. Until receipt of this acceptance has not been confirmed by CEK, the consumer may rescind the contract.
  3. If the agreement is created electronically, CEK take appropriate technical and organizational measures to protect the electronic transfer of data and he will ensure a secure web environment. If the consumer can pay electronically, CEK will take appropriate security measures.
  4. CEK can - within the law - inform if the consumer can meet its payment obligations, as well as all facts and factors relevant to a responsible conclusion of this agreement. If CEK on the basis of this investigation has good reason not to engage the agreement, it’s entitled to refuse an order or request, or to bind special conditions to this order or request.
  5. CEK will, with every product or service, provide the following information to the consumer in writing or in such a way that it can be stored in an accessible manner by the consumer on a durable medium to send: a. The address of the establishment of CEK, where the consumer complaints can be send to; b. the conditions and how the consumer can claim the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal; c. information about guarantees and after sales service; d. the data included in article 4 paragraph 3 of these conditions, unless CEK has provided this information already to the consumer before the execution of the agreement.
  6. Each agreement is entered into under the suspensive conditions of sufficient availability of the products.

Article 6 - Right of withdrawal

Within the statutory period of 14 days you can cancel your order without giving a reason. This can be done in writing (by e-mail to info@cek-gymnastics.com) or by sending the products back, in the original conditions and packaging with sufficient postage. Return the products within the prescribed period (max. 14 days following submission of your revocation) stating your order- or invoice number, name and bank details to

Note: Return shipments from outside the EU are not entitled to a credit for the shipping costs and/or import costs and VAT. Only the returned items will be credited.

Test and / or try on the items just like you would do in a shop.

If you are not satisfied with your purchase, you can send it back. CEK ensures that the amount paid by you, as soon as possible but no later than 14 days after the withdrawal, will be refunded. This is on condition that the product has been received back by the merchant or if a conclusive evidence of complete return can be submitted to the merchant.

Article 7 - Costs in case of withdrawal

Make sure you pay the correct postage to avoid extra cost. The cost of the return shipment will not be reimbursed. All extra cost for shipment will be deducted from your balance. We recommend that you use a shipping service with track and trace. In a dispute, the consumer must prove that the return has been received by us.

Article 8 - Exclusion of right of withdrawal

Excluded from return and cancellation are; Used and / or damaged items, items that are specified by, or made for the customer, or articles unambiguously adapted to the individual requirements of the customer, also known as special orders.

Article 9 - The price

All our prices are including VAT and excluding shipping and optional embellishment. If an item on the image includes options that are not included in the price shown, there will be a brief description stating that the article is shown with optional rhinestones, jewels or additions. Prices are subject to change. The price is valid at time of order. If you have chosen to pay in advance by bank or to pay at pick up, then the price is valid for up to one week after ordering or up to one week after the notification that your order is ready to be picked up and paid. If a price change took place within this timeframe, CEK has the right to adjust the price after the said period of one week.

All prices are subject to printing- and typographical errors. For the consequences of printing- and typographical errors no liability is accepted. CEK is not obliged to deliver the product to the erroneous price in case of printing- and typographical errors.

Article 10 - Compliance and Warranty

CEK does its best to provide you the best quality in handling and delivery of your order. Unfortunately, we also make mistakes, log any defects or faulty goods within two working days after delivery to CEK. The return of the product must be in its original packaging and in new condition.

It also possible that an article contains a manufacturing defect. CEK gives 6 months warranty on manufacturing defects of the products. The warranty starts on the invoice date.

To learn, we take the defective items in return. In accordance with the law, we will repair the item, or compensate you fully or partially. The warranty is given only to manufacturing defects (such as loose seams or stitching, broken elastic etc.) To be eligible for warranty we need: The article, a copy of your proof of purchase (invoice) and in the case of a leotard, we need the leotard together with (size) label that is in the leotard, together with a completed complaint form.

What is a manufacturing defect? This is a defect to a product which is NOT caused by:

  • Improper use (e.g. labels cut from the pack)
  • Normal wear (for example, peeling, thinning of material and loss of shine of the fabric)
  • No or poor maintenance (eg: not washing the leotard after each use)
  • Color running (for example, when light and dark fabrics are combined in a leotard or combined with a short)

Peeling, fading of the color of the fabric, losing the shine of the fabric and losses of the foil of the fabric are normal characteristics of (foil and lycra) fabrics. This is, therefore, not covered by the warranty.

Wear of leather products (grips) is dependent on many factors (including weight of the gymnast and amount of use). The thinning of leather products (grips) is also subject to normal wear and is not covered under warranty.

We are not allowed to process any used apparel that is not properly washed. You (the consumer) are then responsible for the cost of shipping to receive the apparel back, or will pay our laundry costs.

Returned items not covered by the warranty can be picked up at our warehouse free of charge after notification. We can also send the articles back to you after we receive your payment for the costs of the shipment.

Gymnastics apparel can be made of various fragile fabrics. Therefore please visit our website / customer service and read: fabric characteristics , to the different fabric characteristics and their durability. This will avoid disappointments.

Follow the maintenance- and user guidelines for your gymnastics clothing, materials and tools as stated on our website. If you are unsure whether your complaint is covered by the warranty, please first send a photo and a description of the item and the defect by e-mail.

Always ship your return shipment with sufficient postage, or hand it off at our warehouse with all necessary information / forms. Don’t forget to write down your address details and e-mail. Within 2 weeks of receiving your return shipment, the status of your return by e-mail.

Please note that during general holiday periods, this period may be longer.

Article 11 - Delivery and implementation

  1. CEK will do its utmost best to take care of receiving and implementing orders for products and assessment applications for the provision of services.
  2. The delivery location is the address that the consumer has made known to the company.
  3. Subject to what is stated in paragraph 4 of this Article, the company will implement accepted orders expeditiously but not later than within 30 days, unless the consumer has agreed to a longer delivery time. If delivery is delayed or if an order is not, or only partially carried out, the consumer receives them within 30 days after placing the order. In this case, the consumer has the right to terminate the agreement without penalty. The consumer is not entitled to compensation.
  4. All delivery dates are indicative. All delivery timeframes are subject to Products and delivery slot availability. Consumers cannot derive any rights. If, for any reason, CEK cannot meet this timeframe, the consumer has no right to compensation.
  5. In the event of dissolution in accordance with paragraph 3 of this article, CEK will pay back the amount that the consumer has paid as soon as possible, but no later than 14 days after repudiation.
  6. If delivery of an ordered product proves to be impossible, CEK will endeavor to provide a replacement item available. At the latest upon delivery, it will be reported, in a clear and comprehensible manner, that a replacement item will be delivered. For the replacement items, right of withdrawal cannot be excluded. The cost of return shipment are borne by CEK.
  7. The risk of damage and / or loss of products rests with CEK until the moment of delivery to the consumer or a pre-designated and CEK announced representative, unless expressly agreed otherwise.

Article 12 - Payment and shipping

Your order will be shipped as soon as stock is available and your full payment has been received. Did you choose to collect and/or pay on pick-up, you will receive an email when your order is ready. It is not possible to opt for pay on pick-up on items that are custom tailored just for you.

The consumer has the duty to report inaccuracies in data supplied or specified payment details immediately to CEK.

In the event of default by the consumer CEK has, subject to legal restrictions, the right to charge the consumer for the reasonable, advance incurred costs.

Article 13 - Complaints

  1. CEK has a sufficiently advertised complaints procedure and deals with complaints under this complaints procedure.
  2. Complaints about the implementation of the agreement must be submitted completely and clearly described within 7 days CEK, after the consumer has discovered the defects.
  3. Complaints that are submitted to CEK will be answered within 14 days from the date of receipt. If a complaint needs a foreseeable longer processing time, CEK will respond within the period of 14 days with a notice of receipt and an indication when the consumer can expect a more detailed answer. If the complaint cannot be resolved by mutual agreement creates a dispute that is subject to dispute.
  4. Complaints that cannot be solved by mutual agreement, the consumer should turn to Foundation Webwinkelkeur (www.webwinkelkeur.nl), it will mediate free of charge. In case no solution can be reached, the consumer has the possibility to go to foundation GeschilOnline. The verdict of this committee is binding and both entrepreneurs and consumers agree with this binding judgment. The costs of submitting a dispute to the arbitration board are costs which must be paid by the consumer to the relevant committee. Also you can drop your complain at the European ODR platform (http://ec.europa.eu/odr).
  5. A complaint doesn’t suspend the obligations of CEK, unless CEK indicates otherwise.
  6. If a complaint is considered warranted by CEK, CEK will at its option replace or repair the goods and deliver free of charge.

Article 14 - Disputes

  1. Contracts between CEK and the consumer of these terms refer only to Dutch law. Even if the consumer is resident abroad.
  2. The Vienna Sales Convention does not apply.

Article 15 - Additional or different terms

Additional or different provisions of these terms may not be to the detriment of consumers and should be recorded in writing or may be in such a way that the consumer in an accessible manner stored on a durable medium.

Article 16 – Fabric characteristics

On our website you will find a detailed description of the different fabrics that are used to produce gymnastics apparel.

On fabric / color fading, no warranty is given. Please take this into consideration when choosing your leotard.

For fabrics that can fade extremely fast (sometimes already at the first time wearing it) is in the description of the article referred to above fabric characteristics and the warranty.

Article 17 - Care instructions for gymnastic apparel

We advise you to wash the gymnastics apparel after every use in order to maintain the shine of the fabric as long as possible.

Gymnastics apparel is like undergarment worn close to, or direct on the skin, so after every use there will remain bacteria that can affect particular foil fabrics.

We advise to wash all apparel in the washing machine on a short cold rinse cycle. Wash the garments with max. one teaspoon of detergent. On the label on the inside of the garment you will find the washing instruction of the manufacturer of clothing. Remove the garment immediately after the end of the wash cycle of the washing machine. Do not leave it laying around while it's still damp.

Never soak a garment, wash it warm, or use fabric softener, and do not rub or wring.

CEK and its suppliers give no warranty if the garments are not washed and dried according to specifications. If you have chosen a leotard with delicate fabrics and colors, this is at your own risk. The manufacturer can refuse a return of special orders if you have chosen this combination yourself.

Article 18 - Other guidelines for the use of gymnastic equipment and tools

Use your purchased product only as intended. Use tools such as gymnastic grips and home training articles under the supervision of a responsible adult. Gymnastics is a very technical sport that can be practiced only under supervision of a trained person.

Check or have your materials and tools checked regularly for a defect or wear and replace your materials and tools in time to avoid accidents and injuries. CEK is not responsible for any damage resulting from improper use of the products supplied by CEK.

What do we process personal data for

Your personal data are processed by CEK Zwijndrecht for the following purposes:

Article 22 - Trademark and intellectual property

Trademark law covers most of the brands we sell. This includes that we work with an official distribution network, and all intellectual property such as logos, photos, etc. are protected. It is not allowed to sell these brands and / or using intellectual property of these brands without written permission from the official distributor in the country. I you violate this law, you risk immediate justice.
